Legal Status Information
Legal information in Delphion is provided through the EPO-produced INPADOC file, which is updated weekly. In addition, USPTO maintenance status data for US patents has been obtained from the USPTO and loaded into the database.
US maintenance status and INPADOC legal status are displayed in two different fields, as part of Delphion’s integrated (full text) record view. As in some other services, when legal status data is displayed, the status codes are color coded by the system to represent moves toward expiry/rejection (red), verses moves to allowance/legal enforceability (green). This data is available from the integrated document view, which is discussed further in the Viewing Full Text section.
A family legal status report can also be generated by the system. This report will appear in a new window, and contains legal status information for each INPADOC family member of the subject patent (including assignment information, for US documents). The status information is presented in a summarized, color coded table for each family member.
US maintenance status data in Delphion is searchable; it can be searched from the Advanced search interface. This sets the service apart from its competitors, which might offer a status search for an individual document, do not allow maintenance status as a search criterion.
When maintenance status is displayed, the database code is shown next to a “Check current status” link which opens a window showing the date that the US maintenance status data was last uploaded into the system. This window may also contain a disclaimer that the data is from the year 2000 and that the user should check the current USPTO status as an extra precaution. According to the Delphion help desk, this information is just an artifact of the system’s web pages not being thoroughly updated after data uploads to the system. In fact, according to Delphion's staff, the US maintenance status data has been updated at regular intervals, and should be current.
